Win for India as ICJ orders Pakistan Kulbhushan Jadhav’s death sentence

New Delhi: Pakistan had to face disgrace in the International Court of Justice (ICJ) for awarding a death sentence to Kulbhushan Jadhav under the charges of espionage and saboteur activities. Yesterday, the ICJ ordered Pakistan to review Kulbhushan Jadhav’s death sentence, awarded by the Pakistan military court. At the same time, the ICJ accepted the Indian demand of providing legal assistance to Jadhav while blaming Pakistan of violating the Vienna convention in the matter.

The international court ordered Pakistan to transfer the case to a civil court while allowing the Indian demand to provide legal assistance to Jadhav. The ICJ delivered a significant jolt to Pakistan by ordering a review of the verdict while accepting the Indian request for legal aid to Jadhav. Prime Minister Narendra Modi and Minister of Foreign Affairs S. Jaishankar welcomed the decision and is claimed to be a significant victory for India.

Pakistan detained Kulbhushan Jadhav in 2016. In 2017, the Pakistan military court found him guilty and awarded him a death sentence. Pakistan had levelled the charges of espionage in Balochistan under a fake name and executing saboteur activities. According to Pakistan, Jadhav is still working with the Indian security forces.

However, India has denied the allegations and has stated that Jadhav was abducted from Iran and brought to Pakistan. The country pointed out that Jadhav had retired from the Indian Navy in 2003. India underscored the critical fact that Pakistan had never been able to provide details on the circumstances under which Jadhav was captured. Therefore, Jadhav’s case was being handled by the Military court, which has no credibility and information on it was kept confidential. India made 15 demands to allow legal assistance for Jadhav. Each time, Pakistan refused it and has thus gone against the state. The ICJ accepted that it violated the international convention.

A wave of happiness spread across the country on receiving the news of deferment of the death penalty. The people of Satara burst crackers to celebrate the verdict.

Of the 16judges from the international court, 15 voted in favour of the suspension of the punishment. The judge that voted against the verdict was said to be from Pakistan. The decision of the ICJ is a significant win for India although the Pakistani media are claiming that India failed in getting Jadhav released.

After comprehending the verdict was going against it, Pakistan has begun complaining that the ICJ cannot take such a decision regarding Jadhav.
